Few rules about getting a marriage certificate

According to a law passed by the Supreme Court of India in 2006, it is mandatory to register all marriages taking place in the country. This can be done under one of the two Acts:

  • The Hindu Marriage Act, 1955
  • The Special Marriage Act, 1954

The Hindu Marriage Act only applies to Hindus, while the Special Marriage Act pertains to all citizens of India irrespective of religion. The Hindu Marriage Act registers an already celebrated wedding but does not fill in for a celebration of a marriage by a Marriage Registrar. The Special Marriage Act, on the other hand, can celebrate a marriage and its registration by a Marriage Officer.

What is a marriage certificate?

A marriage certificate is a document that can be used for multiple legal purposes, proving a marriage took place. This certificate is important when handling family affairs, dealing with legal and financial concerns, or travelling internationally. If there are any issues with the certificate, the couple will have to apply for a copy of the certificate through the sub-registrar.

What are the main uses of a marriage certificate?

A marriage certificate is an important document when one of the people in the marriage is planning on changing their names. Other than their marriage certificate, they should provide their birth certificate and proof of identification. Post getting their details changed on their Aadhaar card, they can use it to change them on all other documents, like bank accounts, property leases, and titles, they can do the same for contracts, leases, mortgage etc.

When availing health benefits, sharing insurance, claiming pensions or insurance, applicants have to show their marriage certificates. Additionally, there are certain policies only married couples

can apply for, that provide added coverage of a marital coverage plan but applicants have to send their insurance company a photocopy or certified copy of their wedding certificate.

Marriage certificates are a major help when dealing in taxation since there are significant benefits for couples who file taxes together. The couple also has to change their names to match their marriage certificate, tax filing form, and identification documents. Other benefits include applying for mortgages or joint loans. They also have to separately allow lenders to check the credit history and score to make the process easier.

How to apply for a marriage certificate online?

Already married couples with a signed marriage certificate can order copies of their wedding certificates online. The process is usually simple, provided they have their photo ID and proof of relationship.

Can anyone get a copy of their wedding certificate?

To order a copy of the marriage certificate, applicants have to prove their identity as the spouse or a member of the family. They have to submit the:

  • Names of the married couple
  • Date of the marriage
  • Location of marriage
  • Marriage certification (if any)
  • Relationship to the married couple
  • Phone number
