Everything You Need To Know About The Family Code

Family Law or most commonly known as Family Code in the Philippines is the basic law that deals with family matters and domestic relations. To be more specific the Family Law is a legal practice area that focuses on issues involving family relationships such as marriage, adoption, annulment, and child custody, among others. Attorneys that chose to practice family law can represent clients in family court proceedings or in related negotiations. Aside from that they can also draft important legal documents such as court petitions or property agreements.

There are three main areas of work that makes up Family Law. In this article we will discuss all three areas of work and specialization for appreciation and future reference.

  • Matrimonial Law

This law focuses on settling dispute between two parties involved. It covers Marriage, Civil Union and Domestic Relationships. The most common is termination of legally recognized relationships and ancillary matters which includes divorce, annulment, alimony, child support and property settlements.

  • Financial Law

Under this area of work the lawyer will work on the legal documents and negotiation related to the finances of the two parties who have decided to terminate their marriage and have come to settle their finances and properties before parting ways for good.

  • Child Law

This would probably be the most challenging as there is a child or children involved in the dissolution of marriage. This law mandates the support of the father financially to his child or children and must be given automatically. The parents may agree on the amount and manner of payment for child support.

In the absence of such agreement, the court will decide the matter based on the applicable provisions of the Family Code.

Next is you need to determine the place wherein you’re planning to look for a family lawyer as well as where you are planning to file the case. It’s always a good idea to hire an attorney that lives or is based in the area where the two parties are living or in some cases are near within each other’s vicinity. This way, it will be easier to meet and talk about the case.
